The applicant proposes to impact 5,476 linear feet (0.30 acre) of intermittent stream channels by placing approximately 371.5 cubic yards of dredged and fill material within the stream channels to accommodate additional landfill capacity. In addition to the stream impacts, approximately 0.27 acre of an existing pond would be filled with 1,089 cubic yards of material and 0.70 acre of emergent wetlands would be impacted by the placement of approximately 283 cubic yards of dredge or fill material.

The applicant is seeking to conduct maintenance dredging over a 10-year period. The Project area comprises 93 acres of the existing export berth and turning basin along the western shoreline of the Port Arthur Ship Canal within the Sabine Neches Waterway. Up to 300,000 cubic yards of accumulated sediment will be dredged twice a year for ten years from the project area to maintain the authorized dredge depths. All material from each dredge event will be disposed of in approved federal DMPAs 5, 8, 9, 11, 12, 13, 14, 16, and 17. No material will be placed in jurisdictional Waters of the United States (WOTUS). Impacts to special aquatic resources have been avoided, and no compensatory mitigation is proposed. The original permit was issued August 11, 2009, to dredge to an over dredge depth of -48 feet mean lower low water (MLLW).

The applicant proposes to expand an existing barge fleeting facility within the confluence of the Houston Ship Channel (HSC) and Old River (San Jacinto River). The project will include hydraulically or mechanically dredging approximately 570,000 cubic yards of dredged material from 28.5 acres of Old River to a proposed depth of -13.5 feet mean lower low water (MLLW), plus 1.0-foot of allowable overdredge, and the installation of up to 50 mono-pile dolphins and/or deadmen for the mooring and breasting of barges within the proposed expanded barge fleeting area. Dredge material will be placed into upland contained private dredge material placement areas (DMPAs) including East/West Jones, Adloy, Beltway 8 Tract, Stimson Tract, House Tract, Clinton, Laughlin-Thyssin, Greens Bayou, Pinto Lion (Houston Placement Area), Peggy Lake, Lost Lake, Alexander Island, and Spilman Island, depending on capacity and availability.

The Applicant proposes to construct a water treatment wetland in Ellis, Henderson, and Kaufman counties, Texas which would treat up to 150,799 acre-feet per year (ac-ft/yr) of reuse water diverted from the Trinity River before delivering it to Cedar Creek Reservoir. The overall project includes the design and construction of a free water surface wetland, sedimentation basins, and conveyance facilities necessary to transfer water into, through, and out of the constructed wetland system to Cedar Creek Reservoir. Available reuse water for the project would be sourced from the Trinity River, originating as wastewater treatment plant return flows which are currently permitted and contracted. The goal of the project is for the system to provide a maximum of 150 million gallons per day (MGD) of treatment capacity, with a peak flow of up to 176 MGD.
